Can the title of a car be released if both borrowers filed bankruptcy?

I am a co-signer on a car loan. I filed Ch 13 due to other financial reasons and listed the car. Now the other person filed Ch 7 and is giving up the car. I can take over the payment but I want to make sure that the title gets released once the loan is payed off, not when my bankruptcy is discharged in 5 yrs. And the title says “or”. Help!

  1. Let me steer you says:
    Not if you listed the car in your bankruptcy. The car will go back to the finance company who will sell it for what they can get out of it.
