    If you hold the Land Sales Contract and wish to foreclose, then you will need an attorney to protect your rights and ensure you receive the deed to the property back.

    If you are the person being fore closed on, you only need an attorney if you wish to contest the foreclosure. If you don’t intend to go to court and contest it, the Bank handles all the paperwork and you get a letter saying the property will be sold on a particular date. If you don’t contest the sale, you will no longer be the owner after the date of sale.
