receivership of home builder. Can we get our deposit back and get out of the contract if this happens?

I have a home building contract with a company that is speculated to go into receivership with Bank of America. The building process has not begun. Is there any way to get out of this contract and get our deposit back, or will the deposit be caught up in legalities? Should we wait to hear from the builder regarding the return of deposit or should we seek legal help immediately?
